These Terms & Conditions (“Terms”) govern your use of Cherrypik (the “Service”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Independent Service (No Affiliation)
Cherrypik is an independent price-tracking and notification service. Cherrypik is not affiliated with, endorsed by, sponsored by, or partnered with any retailer displayed in the Service. All trademarks and product names are the property of their respective owners.
2. Informational Use Only
The Service provides information for personal, non-commercial use only. You are responsible for verifying prices, promotions, and product details with the retailer before purchasing.
3. Retailer Information Disclaimer
The Service may display pricing and product information that is publicly available from third-party retailers and may be obtained from a variety of sources. Prices and availability can change at any time and may be delayed, incomplete, or inaccurate.
4. Subscriptions & Billing
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
- Billing and refunds are handled by the Apple App Store, subject to their policies.
- You can manage or cancel your subscription in your platform account settings.
5. Acceptable Use
You agree not to:
- Reverse engineer, copy, or create derivative works of the Service.
- Copy, reproduce, distribute, resell, or commercially exploit any part of the Service or its outputs.
- Attempt to bypass subscription limits or access controls.
- Use automated or excessive requests that interfere with the Service’s normal operation.
6. Abuse, Security & Access Restrictions
We may monitor and enforce reasonable limits to protect the Service. We may restrict, suspend, or terminate access if we believe you are engaging in abuse, fraud, excessive automated access, or activities that interfere with the Service.
7. No Warranty
The Service is provided “as is” and “as available.” To the maximum extent permitted by law, Cherrypik makes no warranties, representations, or guarantees of any kind, whether express or implied, including as to accuracy, completeness, timeliness, availability, or fitness for a particular purpose.
8. Limitation of Liability
To the maximum extent permitted by law, Cherrypik will not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, loss of savings, loss of data, or missed deals, arising out of or in connection with your use of the Service. Nothing in these Terms excludes, restricts, or modifies any consumer rights or remedies you may have under the Australian Consumer Law that cannot be excluded, restricted, or modified by agreement.
9. Indemnity
You agree to indemnify and hold harmless Cherrypik, its directors, officers, employees, and contractors from any claims, losses, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of: (a) your misuse of the Service, (b) your breach of these Terms, or (c) your violation of any applicable law or third-party rights.
10. Changes
We may update these Terms from time to time. Continued use of the Service after changes means you accept the updated Terms.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law.
